Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings. Discussion and possible action to enter into AIA C172-2014 Standard Form of Agreement Between Owner and Program Manager (Owners Representative) with Gilpin Engineering Company for basic services to include, but not limited to, updating the Fairground master plan, oversee process of designing, constructing and renovating the fairgrounds, provide preliminary evaluation of County's program, schedule, and construction budget, assist in determining consultants, selecting services of testing labs, coordinating services of surveyors, establish building information modeling and digital protocols, develop Project Management Plan and a Project Management Information System, establish project budget, budget controls, establish quality control guidelines, visit the site, report on projects progress, make observations and report deficiencies in the performance of the consultants and contractors at a cost not to exceed One Million Dollars ($1,000,000) and Additional Services, in the amount not to exceed Six Hundred Thousand Dollars ($600,000) for services, including but not limited to, cost estimating services, preliminary estimate of cost of the work, evaluations of alternative materials and systems, written recommendations regarding add and deduct alternatives, construction contract administration services, one or more representatives on-site when work is being performed, review testing and inspections, recommend to county and architect, reduction of the work when non-compliant, review change orders, change directives, evaluate if work is substantially complete; and any matters incident thereto and authorizing the County Judge to sign all relevant documents.
